Specific Relief Act, 1963 – Birdseye View (Judiciary Focus)

PART I – Preliminary

  • Applies to: All of India

  • Purpose: Enforce civil rights, not penal laws

  • Sec. 2 Key Definitions:

    • Obligation = legal duty

    • Trust = as per Indian Trusts Act, 1882


PART II – Specific Relief

Chapter I – Recovery of Possession

  • Sec. 5: Rightful owner can recover specific immovable property

  • Sec. 6: Possession can be restored even without ownership if dispossessed unlawfully

  • Sec. 7 & 8: Recovery & delivery of movable property


Chapter II – Specific Performance of Contracts

A. Contracts which can be specifically enforced

  • Sec. 10 & 11: Enforced unless exceptions apply; trust-related contracts are enforceable

  • Sec. 12: Part performance possible only in limited situations

  • Sec. 13: Rights of purchaser/lessee against no or imperfect title

B. Contracts which cannot be specifically enforced (Sec. 14):

  • Continuous duty not supervisable

  • Based on personal qualifications

  • Determinable contracts

  • Substituted performance already taken

C. Who can claim performance (Sec. 15):

  • Parties to the contract

  • Beneficiaries, representatives, reversioners, LLPs, companies

D. Personal Bars (Sec. 16):

  • Not ready & willing

  • Fraud/violation

  • Substituted performance taken

Other Important Concepts:

  • Sec. 17: No title = No enforcement

  • Sec. 18: Variation must be proven

  • Sec. 20: Substituted performance allowed with notice

  • Sec. 20A-C: Special provisions for infrastructure projects

  • Sec. 21-24: Damages & compensation available; bar after dismissal


Chapter III – Rectification of Instruments

  • Sec. 26: Rectification if fraud or mutual mistake proven


Chapter IV – Rescission of Contracts

  • Sec. 27: When contracts can/cannot be rescinded

  • Sec. 28-30: Especially for sale/lease of immovable property


Chapter V – Cancellation of Instruments

  • Sec. 31: Cancellation if instrument is void/voidable

  • Sec. 32-33: Partial cancellation, benefit restoration


Chapter VI – Declaratory Decrees

  • Sec. 34: Declaration of legal status/rights

  • Sec. 35: Binding only on parties to suit


PART III – Preventive Relief

Chapter VII – Injunctions (General)

  • Sec. 36-37: Injunction = temporary or perpetual

Chapter VIII – Perpetual & Mandatory Injunctions

  • Sec. 38: Perpetual injunction to prevent breach of obligation

  • Sec. 39: Mandatory injunction to compel performance

  • Sec. 40: Damages also claimable

  • Sec. 41: Grounds when injunction is refused (e.g., nuisance not proven, criminal cases, etc.)

  • Sec. 42: Negative agreement enforceable even if affirmative isn't


Key Terms to Remember

  • Specific Relief = Enforcing civil rights by doing or not doing an act

  • Injunction = Court's order to stop or compel an act

  • Substituted Performance = Done through third party, then recover cost

  • Rectification = Correcting document mistake

  • Rescission = Cancellation of contract

  • Declaratory Decree = Legal recognition of status/right

  • Negative Agreement = Agreement not to do something (enforceable under Sec. 42)
